Termina la demanda por los emails de la Gobernadora

Más de dos años después de ser archivada en una corte federal, la demanda sobre emails filtrados en la campaña 2010 de la gobernadora Susana Martinez fue desestimada con prejuicio el lunes.

Los abogados de los dos lados presentaron una moción de desestimación, lo cual probablemente resolverá el asunto.

“Se lo desestimó con prejuicio,” Bruce Wetherbee, uno de los acusados de la demanda, dijo a NM Political Report. “Fin de la historia.”

Desestimado con prejuicio significa que la demanda no puede estar presentada de nuevo.

Wetherbee trabajó con Independent Source PAC cuando el comité de acción política liberal reveló públicamente algunos emails filtrados del personal de la administración de Martinez en 2012.

Él se unió con el Presidente anterior del Partido Demócrata Sam Bregman, el Director anterior de la campaña de Martinez Jamie Estrada, el asistente anterior de la campaña de Martinez Anissa Ford, el Director Ejecutivo anterior de Independent Source PAC Michael Corwin y el operativo del estado del Partido Demócrata Jason Loera como acusados en la demanda.

La demanda acusó a los seis imputados de piratear ilegalmente y dar a conocer públicamente algunos emails con información confidencial.

Entre otras cosas, los emails arrojaron evidencia sobre presiones e influencias internas dentro de la administración de Martinez y también sobre las decisiones controversiales como la decisión del estado de extender del alquiler por 25 años del Downs al Albuquerque Racetrack and Casino. Los emails también mostraron que la administración de Martinez dirigió negocios públicos usando los canales privados de correo electrónico.

Entre aquellos que se sienten apenados por la revelación de correos era Pat Rogers, abogado de Albuquerque, cabildero y presidente anterior del comité nacional republicano quién representó a Downs durante el proceso de licitación para la extensión del alquiler. En uno de los emails él se burló de que la reunión de Martinez con los nativos americanos avergonzaría a Col. George Armstrong Custer, la revelación de los emails llevó a la resignación de su puesto de vicepresidente del Modrall Sperling Lawfirm.

Rogers era uno de los abogados que representaba a los cuatro demandantes que actuaron en el juicio. Él y varios otros abogados involucrados en la demanda, en ambos lados no regresaron llamadas de NM Political Report el martes por la tarde.

Los demandantes eran Crystal Amaya, Brad Cates, Brian Moore, y Kim Ronquillo, cuyos nombres aparecieron en la filtración de los emails.

Mientras que el Independent Source PAC reveló algunos de los emails relativos a Downs u otros negocios del estado, la mayoría fueron publicados por el Santa Fe Reporter después de que el periódico los obtuvo en 2012 por medio de una solicitud de documentos públicos con el entonces Fiscal General Gary King*. Corwin había entregado los emails a la oficina de King después de pedir una investigación sobre el asunto de Downs.

La oficina de Martinez y otros aliados se enfocaron en los emails privados que King reveló al Santa Fe Reporter como registro público, escribió Steve Terrel del Santa Fe New Mexican en 2014.

A lo largo del proceso Martinez alegó que los emails fueron robados y le pidió al FBI de intervenir. Una investigación eventualmente dio lugar a la acusación de Estrada, quién se declaró culpable de interceptar algunos de los emails.

Los cuatro demandantes presentaron la demanda en junio de 2014. Rogers hizo pronto una solicitud de comparecencia después de que el Santa Fe Reporter divulgara su relación con la demanda.

Rápidamente, Corwin se defendió diciendo que estaba dentro de los derechos de la Primera Enmienda de “publicar información de gran preocupación al público.”

A lo largo del camino, los demandantes intentaron sin éxito de prevenir que el público tenga acceso a los emails filtrados, aunque los emails ya habían estado publicados y estuvieron disponibles para cualquier persona leer en la página web del Santa Fe Reporter hace más de tres años.

También intentaron de obtener los emails intercambiados entre Ford y el periodista Justin Horwath de Santa Fe New Mexican, otra vez sin éxito.

No está claro si la desestimación de la demanda incluyó un acuerdo, y en tal caso no se sabe cuáles habrían sido los términos del mismo.
