By Kevin Hendricks — Voters in House District 64 sent Andrea Reeb back to Santa Fe on Tuesday, three weeks after she quit. Now the Clovis Republican says she’s coming back to the House.

Reeb announced Thursday that she will take her seat for the upcoming term. She won re-election to the seat representing Chaves, Curry and Roosevelt counties without an opponent.

“The people of District 64 asked me to serve, and I’m going to,” Reeb said in a news release.

Reeb resigned Oct. 15, one day after a federal judge ruled in Baldwin v. Morrissey that serving as both a legislator and a special assistant district attorney violated the separation of powers in the New Mexico Constitution, NM Political Report previously reported. The case grew out of Reeb’s time as a special prosecutor in the manslaughter case against actor Alec Baldwin.

In her resignation letter, Reeb said she relied on a 2023 State Ethics Commission informal opinion and a 2024 attorney general opinion that addressed legislators working as contract prosecutors. She said she resigned quickly because staying could have put dozens of criminal cases at risk.

Her name stayed on the ballot because she was already running unopposed.

Reeb plans to keep doing special prosecutor work through the end of the year while she hands pending cases to other attorneys. In January, she will join the law firm of Payne, Powell, Truitt and Chandler as a partner, which she says resolves the conflict before the legislative session.

The seat stays vacant for the rest of the current term unless the governor fills it. County commissions in all three counties can nominate a replacement, and Gov. Michelle Lujan Grisham chooses from those nominees.
