New Mexico’s high school graduation rate rose to 71 percent in 2016, the highest percentage since the state began tracking four-year rates in 2008, Gov. Susana Martinez announced Monday. The rate jumped 2½ points from the previous year and increased in 48 of the state’s 89 school districts in 2016, including Albuquerque, Las Cruces, Rio Rancho and Santa Fe. “With more students graduating high school than ever before, New Mexico is better preparing our kids to enter the workforce, college and beyond,” Martinez said at a news conference at the Greater Albuquerque Chamber of Commerce. The governor used the occasion to again push her plan to end the practice of so-called social promotion — moving students forward to the next grade — for third graders who cannot read proficiently. The graduation rate for Santa Fe Public Schools in 2016 was 71 percent, up from 66.8 percent for the previous year.
Legislators on opposing sides of the aisle are using remarkably similar arguments on two bills that would delay tax breaks and subsidies to businesses to help balance New Mexico’s projected $460 million shortfall between last year and this year. One would delay incoming corporate tax cuts for two years, saving the state an estimated $13.8 million this fiscal year, according to the Legislative Finance Committee,
The other bill would generate $20 million by cutting New Mexico’s film industry subsidy by that much this year. While both bills bear similarities in delaying tax breaks and subsidies for businesses, they’re being both supported and opposed on nearly opposite partisan lines. Democratic leadership in the Roundhouse argued that businesses must participate in the “shared sacrifice” of cuts to solve the state’s budget crisis when supporting the corporate tax cut delays that the Senate passed last weekend. House Minority Leader Brian Egolf, D-Santa Fe, emphasized this point when criticizing proposed cuts to services in the Republican budget plan Monday morning in his office.
Just three years ago, the New Mexico Legislature significantly changed what manufacturers owe in taxes in the state. Legislators squarely aimed the changes at one big company: Intel. Next year, the tax changes will fully eliminate payroll and property taxes for manufacturers and instead only tax them on their in-state sales. After Senate passage last week, a proposed constitutional amendment that would change the bail process in New Mexico cleared its first House committee Monday afternoon. The bill would allow general election voters this fall to weigh in on allowing a judge to deny bail to defendants deemed dangerous to society. Under the amendment, defendants who don’t present a danger to society could not be held if the only thing keeping them in jail was a lack of money
The House Judiciary Committee passed the bill 7-2, with Reps. Zach Cook, R-Ruidoso, and David Adkins, R-Albuquerque, casting to only dissenting votes. The bill has support from criminal defense attorney organizations, public defender offices, civil liberty groups and city and county organizations.
Emotional testimony and talk about heated rhetoric preceded a unanimous vote Friday in the Senate Judiciary Committee to pass a bill to put New Mexico in compliance with the federal REAL ID Act on. Lawmakers crowded the table where sponsors sit while presenting legislation, with Senate sponsors John Arthur Smith, D-Deming and Stuart Ingle, R-Portales, crowded next to House sponsors Andy Nuñez, R-Hatch and Paul Pacheco, R-Albuquerque. State Taxation and Revenue Department Secretary Demesia Padilla also sat at the table. The committee commended Smith and Ingle for working on a compromise bill separate from the House bill that cleared the Senate Public Affairs Committee after extensive changes. “The big, fundamental difference when you really get down to it [is] the ability to opt out of REAL ID,” Smith told NM Political Report after the hearing.
Two competing proposals for reforming New Mexico’s bail process moved forward on Monday, setting up an inevitable clash as they move towards the floors of the House and Senate. The Senate version has two components: It would allow judges to deny release of those awaiting trial if they are deemed a danger to the public and it would allow judges to not impose bond if the only thing keeping someone accused of a non-violent crime in jail is a lack of ability to pay bond. The House version only has the first part, on allowing judges to keep those deemed dangerous in jail until trial. In the Senate Judiciary Committee, Sen. Peter Wirth, D-Santa Fe, presented his version along with New Mexico Supreme Court Justice Charles Daniels. Wirth said the legislation was “narrowed dramatically” since he started the vetting process through interim committees last year.
State lawmakers are debating whether to ask voters to change the Constitution and give judges more flexibility in the state’s longstanding cash bail system. Two proposals vie for their attention and if either wins the Legislature’s approval, it would go before voters in November. One would allow judges to deny bail to defendants deemed dangerous but let those who are not go free before trial if financial hardship is all that’s keeping them behind bars. The other addresses dangerous defendants but not individuals too poor to afford bail. Currently, the New Mexico Constitution allows nearly all criminal defendants the chance for freedom before trial, so long as they can afford it.
Dueling philosophies between lawmakers on how to solve that state’s problem with drunk driving peppered debate in a House committee Thursday afternoon. Lawmakers in the House Safety and Civil Affairs Committee heard three bills to add penalties to DWIs, all of which passed on mostly partisan grounds. Two of the bills, in fact, were called “Increase Certain DWI Penalties.”
One makes driving a car with a revoked driver’s license a fourth degree felony while punishing those who knowingly allow people with revoked licenses drive their cars. Another increases penalties for the fourth DWI by a year and ups someone’s eighth DWI from a third degree felony to a second degree felony. The third bill seeks to add DWI sentences to state habitual offender laws.
The latest dire predictions for the budget came from the Greater Albuquerque Chamber of Commerce, just a day before legislators gather and Gov. Susana Martinez gives her State of the State Address. In an online newsletter previewing the session, the Chamber started the discussion of the budget by saying, “It’s not going to be a fun year.” The reason? Oil prices. The budget projections assumed nearly $50 per barrel of oil.
