The Democrats in New Mexico’s congressional delegation want to end “lunch-shaming” nationwide. The members introduced legislation in both the U.S. House and U.S. Senate to end the practice. The Anti-Lunch Shaming Act would ban schools from singling out children for their parent’s inability to pay for school lunch. Some schools make children whose parents can’t afford lunch wear wristbands or stamps on their hands or perform extra chores. Earlier this year, New Mexico became the first state in the nation to outlaw the practice.
The state Senate majority leader says three bills that Gov. Susana Martinez vetoed during the last week will become law after all, including legislation that would legalize research of industrial hemp. Setting up a constitutional showdown, Sen. Peter Wirth, D-Santa Fe, told the chamber Thursday night that Martinez had missed her deadline to veto the bills. The governor has three days during a legislative session to sign or veto bills. If she does neither, the bills become law. The constitution also says governors are to state their objections when vetoing a bill, giving lawmakers some sort of explanation.

Gov. Susana Martinez on Wednesday vetoed six bills that cleared the Legislature with overwhelming support, rankling lawmakers who complained that she never explained any of her decisions. Martinez’s own tone was equally sharp when she called a Senate override of one of her vetoes a stunt, even though that challenge to her was initiated by a fellow Republican. But when it came to issuing veto messages, Martinez didn’t give legislators any idea of why she rejected bills ranging from an uncontroversial proposal that would have given local governments a new option to pay for expanding broadband networks to arcane changes in horse-racing regulations. The day before Martinez spiked the six bills, the Senate voted 34-7 across party lines to override her veto of a bill to let teachers use more sick days without being downgraded on their performance evaluation.
Gov. Susana Martinez personally lobbied the Senate’s top Democrat to support a controversial bill that would have created an exception in government rules and allowed state agencies to extend their leases at a building owned by donors to her campaign. Senate Majority Leader Peter Wirth, D-Santa Fe, said Monday that Martinez asked him to support the measure after he had voted against it in a committee hearing. “I was concerned about having a state law that overrides an agency’s rule,” Wirth said. But during a later conversation, Martinez asked him to reconsider, Wirth said. As majority leader, Wirth held off bringing the measure to a vote by the full Senate, and he asked another senator to vet its legality.
In an extraordinary maneuver, state senators killed a bill Saturday that they had approved four days earlier after one of them said he had misled his colleagues about connections between Republican Gov. Susana Martinez and real estate developers who stood to benefit from the legislation. Democrats charged that the bill, which would have extended a building lease for state offices in Albuquerque, had turned into an example of pay-to-play politics, while members of Martinez’s administration maintained they had made an honest mistake based on incomplete information. For her part, Martinez said through a spokesman that neither she nor her staff ever discussed with campaign donors the leases addressed in the measure. At issue was an unusual and late-breaking piece of legislation, Senate Bill 430, that met with skepticism at just about every step of its journey through the Capitol until its sudden death Saturday. Sponsored by Sen. Steve Neville, R-Aztec, the bill would have carved out an exception to state rules on renting property.
New Mexico lawmakers are delivering on a promise to improve one of the state’s last-in-the-country rankings — the speed of broadband internet. Several bills are moving through the Legislature, and two have cleared the Senate and House of Representatives and are heading to Gov. Susana Martinez for her consideration. Each would make it easier to expand broadband internet to underserved rural areas where the sparse population makes it difficult for companies to recoup their costs. House Bill 60 would allow private companies installing fiber optics to share a trench unearthed by the state or a local government. The change reclassifies broadband as an economic development project and exempts it from a constitutional provision that prohibits taxpayer support to private companies.
Lawmakers looking for every possible penny of new revenue to balance the state budget moved ahead with an omnibus tax package Wednesday over the objections of hospitals and medical providers that claimed paying more to the state would harm health care in New Mexico. House Bill 202 is part of an effort to bring in revenue from the fastest-growing part of the state’s economy — physicians, hospitals and clinics, most of which now pay little or no gross receipts tax. Rep. Carl Trujillo, D-Santa Fe, said his bill equalizes the tax among the entire health care sector at just over 3 percent — and that amount is paid on just 40 percent of patient revenue. “I don’t know how you can be more fair than everyone in this profession paying the same,” he said. The measure would raise $250 million for the general fund and restore cash reserves to about 4 percent, Trujillo said.
On Tuesday a bill to fund early childhood education programs with two new taxes on energy and electricity producers failed to make it out of committee. During the Senate Conservation Committee meeting, Sen. Michael Padilla, D-Albuquerque, sought support for a bill that would create an early childhood education fund paid for by a one-hundredth percent oil and gas energy surtax and a one cent per kilowatt hour tax on electricity produced in New Mexico. The two revenue sources would generate more than $320 million annually, according to the fiscal impact report for Senate Bill 288. Once the meeting was opened for public comments, not one audience member spoke in support of the bill. But more than a dozen lobbyists and representatives of the oil and gas industry and utilities like PNM, El Paso Electric, Xcel Energy and Tri-State Generation and Transmission opposed it.
The Senate Education Committee has unanimously tabled a bill that would have established a new endowment for early childhood programs in the state using revenues from federal mineral rights leases on public lands — assuming Congress approved a proposal by State Land Commissioner Aubrey Dunn to share the funding. The bill’s sponsor, Sen. Mary Kay Papen, D-Las Cruces, asked the committee to table the measure Wednesday, saying, “It is clear to me now … that the bill suffers from problems in its construction.” In conversations with legislators, educators, Dunn and others, she said, she discovered “this entire approach has little support from the public.” Opponents of Senate Bill 182, including the New Mexico Wildlife Federation, said one of its faults is that it assumes the federal government would agree to share proceeds with the state from leasing 6.6 million acres of mineral rights on private land.
